“Positions in front of the responsibility of children and girls that transgress the law”
Resumen
La discusión acerca de cómo niños y niñas judicializados deben responder por los hechos delictivos cometidos, genera dos posiciones dominantes. La primera exige una especial penalización, mientras que la otra solicita responsabilización social y psicológica”. Este artículo discute ambas posturas en busca de una síntesis que tome lo mejor de ambas corrientes de pensamiento. Propone garantizar juicios justos, coartando la tradicional discrecionalidad judicial en este campo, a la par que rechaza todo sistema de penas especiales como vía para la construcción de responsabilidad social y subjetiva. Inscribe esta alternativa en el campo de la Justicia Restaurativa a diferencia de los Sistemas de Responsabilidad Penal Juvenil. Propugna las nociones de sanción co-responsabilizante antes que la de sanción responsabilizante, y Garantismo Integral antes que la de Garantismo Penal.

Abstract
The discussion about how boys and girls judicializados, should respond for the made criminal facts, generates two dominant positions. From a special “penalization “is demanded while from the other one, social and psychological responsabilización is requested”. This way, he/she intends to guarantee fair trials, hindering the traditional judicial discrecionalidad in this field but, at the same time, it rejects all system of special hardships as via for the construction of social and subjective responsibility. It inscribes this alternative in the field of the Restorative Justice contrary to the Systems of Juvenile Penal Responsibility”. Propugna the sanction notions co-responsabilizante before that of sanction responsabilizante”, and that of Integral Garantismo before that of Penal Garantismo.”
