Resumen
El decreto 780 de 2016 es modificado por el decreto 1273 del 23 de julio de 2018 cambiando los plazos para el pago de las cotizaciones de los aportes de los trabajadores independientes, que no serán anticipados sino mes vencido, según su artículo 3.2.7.6: “se efectuará a partir del 1° octubre de 2018, correspondiendo al periodo de cotización del mes septiembre del mismo año”, a partir de 2018 la responsabilidad del recaudo se transfiere a los contratantes. Y al mismo decreto 780, se le adiciona el título siete que fija como Ingreso Base de Cotización (IBC) para trabajadores independientes será mínimo del 40% del valor mensual de cada contrato y aclara que: “En ningún caso el IBC podrá ser inferior al salario mínimo mensual legal vigente ni superior a 25 veces el salario mínimo mensual legal vigente”, (Decreto 1273, 2018, art. 3.2.7.1). Esta norma tiene incidencia en los protocolos y procedimientos de celebración de contratos por prestación de servicios y honorarios, ya que para tramitar el respectivo pago se solicitaba al trabajador independiente copia del pago de Planilla de Seguridad Social correspondiente al mes del servicio prestado
