Resumen

Después de que el Congreso de la República, expidiera la Ley 1787 de 2016, la cual estableció el marco normativo y científico para investigar acerca del cannabis medicinal, regulando su producción, distribución y comercialización en el contexto nacional y extranjero, ha surgido un gran interés por parte de inversionistas y empresarios hacia el sector de cannabis con fines medicinales en Colombia. Sin embargo, pese a que el marco regulatorio es uno de los más completos a nivel latinoamericano, se perciben algunos obstáculos que no han permitido el impulso de esta industria. Con el fin de evaluar cuáles son, se desarrolla la metodología con un tipo de investigación mixta (cualitativa y cuantitativa), abordando un alcance de tipo exploratorio, con el uso de técnicas de recolección de información como revisión documental, entrevista semiestructurada y una matriz PEYEA. A partir de los resultados, se logra evidenciar que los principales desafíos y condicionantes que enfrenta la industria actualmente son el acceso a pacientes y al mercado interno, la educación y la descriminalización entorno a la planta, la gestión pública, las barreras de acceso al sector financiero y, finalmente, las altas inversiones de capital que se requieren para su desarrollo. Por cuenta de una respuesta institucional lenta, aumenta el riesgo de que el negocio de Cannabis medicinal no sea aprovechado de la mejor manera en Colombia pese a todas las ventanas de oportunidades que se han abierto, en particular, en la industria de CBD con fines medicinales y terapéuticos

After the Congress of the Republic issued Law 1787 of 2016, which established the normative and scientific framework to investigate medical cannabis, regulating its production, distribution and commercialization in the national and foreign context, great interest has arisen by investors and entrepreneurs towards the cannabis sector for medicinal purposes in Colombia. However, despite the regulatory framework being one of the most complete in Latin America, there are some obstacles that have not allowed the promotion of this industry. In order to evaluate what they are, the methodology is developed with a mixed type of research (qualitative and quantitative), addressing an exploratory scope, with the use of information collection techniques such as documentary review, semi-structured interview and a SPACE matrix. From the results, it is possible to show that the main challenges and conditioning factors currently facing the industry are access to patients and the internal market, education and decriminalization around the plant, public management, barriers to access to the sector financial and, finally, the high capital investments that are required for its development. Due to a slow institutional response, increases the risk that the medical Cannabis business will not be used in the best way in Colombia despite all the windows of opportunities that have been opened, in particular, in the CBD industry for medicinal and therapeutic purposes
