Resumen
El objetivo de este proyecto es elaborar una propuesta metodológica para el establecimiento de la tasa retributiva por la utilización directa de la atmósfera como receptor de emisiones contaminantes provenientes de fuentes fijas puntuales en la cuidad de Bogotá D.C. Los contaminantes objeto de cobro de la tasa retributiva se seleccionaron relacionando los contaminantes regulados por la normatividad Distrital la Resolución 1208 de 2003, con los principales contaminantes que emiten las fuentes fijas y con los contaminantes que son monitoreados por la Red de Monitoreo de la Calidad del Aire de Bogotá (RMCAB). Y Teniendo en cuenta que en un principio solo pueden ser objeto de cobro aquellos contaminantes con los que se cuente con la capacidad técnica y operativa de monitorear y controlar; se seleccionó el material particulado (PM10), el dióxido de Azufre (SO2) y el dióxido de Nitrógeno (NO2) como los contaminantes atmosféricos que deben ser objeto de cobro. Posteriormente se realizó el análisis de la estructura de la tasa retributiva la cual se centro en la descripción de cuatro elementos claves; del hecho generador, la base imponible, el sujeto pasivo y activo de la tasa. Teniendo en cuenta los costos sociales los cuales están relacionados con la inversión que realiza el distrito para la atención a pacientes que presentan enfermedades respiratorias agudas ERA´s asociadas a la contaminación atmosférica en Bogotá; y los costos del programa de control y vigilancia de la calidad del aire de Bogotá.se definieron las tarifas para el cobro de la tasa retributiva en 2810 $/Kg para el PM10, 2816 $/Kg para los SO2, y 2866 $/ Kg para los NO2. Finalmente se estableció el modelo de cobro de la tasa, el cual es el resultado de multiplicar la tarifa correspondiente para cada uno de los contaminantes objetos de cobro, expresada en ($/Kg), por la carga contaminante emitida por la fuente expresada en (Kg/día) por el número total de días de operación de la fuente de emisión al año.

The aim of this work is to develop a methodological proposal for the stablishment of the retributive rate for the direct use of the atmosphere as the receptor of pollutant emissions that come from stacionary resources on Bogotá D.C. The pollutants that should be in the object of payment in the retributive rate were selected linking pollutants covered by the regulations District Resolution 1208 of 2003, with the main pollutants emitted by the stationary sources and pollutants that are monitored by the Monitoring of Quality Air de Bogota (RMCAB). And Taking into account that initially can only be subject to recovery with those pollutants that have the technical and operational capacity to monitor and control; was selecting the particulate matter (PM10), sulphur dioxide (SO2) and Nitrogen dioxide (NO2) as atmospheric pollutants that should be object to payment. Furthermore the analysis of the retributive rate structure was made wich was based on the description or four key elements the generated fact, the tax base, the passive subject, and the fee of the rate. Taking into account the social costs which are related to the invesment being made by the district of Bogotá for the treatment of patients that present acute respiratory diseases ERA´s, associated and the costs of program control and monitoring of the air quality in Bogotá, the tariffs of the payment of the retributive rate were redefined in 2810 $/Kg for the PM10, 2816 $/kg for the SO2 and 2866 $/kg for de NO2. Finally a new model of the payment was established, which is the result of the multiplication of the respective tariff for each of the pollutants that were selected as object of payment, expressed in ($/kg) times, the charge of the pollutants emitted by the source expressed in (kg/day).times the total number of days of the operation of the source emissions in a year.
