Resumen
El presente documento de investigación no pretende postular nuevas teorías acerca del totalitarismo o del realismo jurídico, pero si se quiere mostrar una realidad que crece de manera constante dentro del sistema judicial y conspicua con la vida cotidiana en el ámbito jurídico colombiano. Nos referimos a la realidad de los estrados judiciales y la amplia discrecionalidad de los jueces que conlleva a la construcción de una justicia que ha desbordado el paradigma de lo justo, al servicio de los sentimientos, el yerro interpretativo y las vanidades de quienes encumbran el poder, afectando la dignidad del hombre al restringir su libertad de manera preventiva cada vez con mayor ligereza. De algún modo este fenómeno se ha convertido en el Leviatán de hoy, con profunda incidencia en pensamientos de guerra de quienes sufren los desmanes de los jueces, creando situaciones de descontento en la población afectada directa e indirectamente construyendo sentimientos de antiderecho, cuya génesis no es otra que el irrespeto que muestran los jueces con sus decisiones por la dignidad de hombres y mujeres; desconociendo los preceptos jurídicos de orden superior y rompiendo la estrecha conexión con los derechos humanos, en donde el respeto por la dignidad del hombre marca el derrotero de los demás derechos como el derecho a la libertad, al cual le daremos la mayor relevancia dentro del presente documento. Se pretende construir o acuñar un nuevo término dentro de la filosofía político juridica, “totalitarismo jurídico invertido”, el cual resulta del análisis histórico del derecho, pasando por el totalitarismo invertido, la amplia discrecionalidad concedida por el sistema judicial a los jueces y el irrespeto por la dignidad humana por parte del Estado que se evidencia con algunas decisiones dentro del sistema judicial colombiano las cuales están creciendo de manera soterrada alejándose de la senda del derecho

This research document does not pretend to postulate new theories about totalitarianism or legal realism, but it does want to show a reality that is constantly growing within the judicial system and conspicuous with daily life in the Colombian legal environment. We refer to the reality of the judicial courts and the wide discretion of the judges that leads to the construction of a justice that has exceeded the paradigm of fairness, at the service of feelings, interpretive error and the vanities of those who exalt power. , affecting the dignity of man by restricting his freedom in a preventive way more and more lightly. Somehow this phenomenon has become the Leviathan of today, with a profound impact on thoughts of war of those who suffer the excesses of the judges, creating situations of discontent in the affected population directly and indirectly, building feelings of anti-right, whose genesis is not other than the disrespect that judges show with their decisions for the dignity of men and women; ignoring the legal precepts of a higher order and breaking the close connection with human rights, where respect for the dignity of man marks the course of other rights such as the right to freedom, to which we will give the greatest relevance within the present document. It is intended to construct or coin a new term within the political-legal philosophy, "inverted legal totalitarianism", which results from the historical analysis of the law, passing through inverted totalitarianism, the wide discretion granted by the judicial system to judges and the disrespect for human dignity by the State that is evidenced by some decisions within the Colombian judicial system which are growing underground, moving away from the path of law
